2. Service Description
SmartMalwareScan is a website security scanning service that:
- Scans publicly accessible URLs for malware, phishing content, blacklist status, SSL/TLS configuration, and security headers
- Provides AI-generated threat analysis and security reports
- Offers daily monitoring for Pro subscribers
- Provides educational security content via our blog
The Service scans only publicly visible website content. We do not access private areas, admin panels, or non-public data of any website.
3. Free & Pro Plans
3.1 Free Plan
The Free Plan allows up to 11 URL scans per day without creating an account. Free scans reset every 24 hours. No credit card or registration is required for the Free Plan.
3.2 Pro Plan
The Pro Plan is a paid subscription offering unlimited daily scans, monitoring, and additional features. By subscribing to Pro, you agree to:
- Pay the applicable monthly or annual subscription fee
- Provide accurate billing information
- Keep your payment method current
3.3 Free Trial
We may offer a free trial period for the Pro Plan. At the end of the trial, your payment method will be charged automatically unless you cancel before the trial ends.
3.4 Plan Changes
We reserve the right to modify plan features and pricing with reasonable advance notice to existing subscribers. Material changes will be communicated by email at least 14 days in advance.
4. Acceptable Use
You may use SmartMalwareScan to:
- Scan websites that you own or manage
- Scan publicly accessible websites for legitimate security research
- Check URLs before visiting them to protect yourself or your users
- Monitor your own websites for security threats (Pro plan)
- Generate security reports for clients (with appropriate permissions)
5. Prohibited Activities
You must not use our Service to:
- Scan websites without authorisation from the website owner where local laws require such consent
- Automate large volumes of scans in a way that constitutes abuse or denial-of-service against our infrastructure or target websites
- Attempt to circumvent rate limits, access restrictions, or security measures
- Use the Service for any illegal purpose or in violation of any applicable law
- Reverse-engineer, decompile, or attempt to extract the source code of our Service
- Resell, sublicense, or provide the Service as a white-label product without our written consent
- Use automated bots or scripts to access the Service beyond what is expressly permitted by the API terms
- Share your account credentials with others
- Submit fraudulent payment information
Violation of these prohibitions may result in immediate account termination without refund.
6. Payment & Billing
6.1 Billing
Pro subscriptions are billed in advance on a monthly or annual basis. All prices are in USD unless otherwise stated. Payments are processed by Dodo Payments, our Merchant of Record. By subscribing, you agree to Dodo Payments' terms of service.
6.2 Cancellation
You may cancel your Pro subscription at any time from your account dashboard. Upon cancellation:
- You retain Pro access until the end of your current billing period
- No further charges will be made
- No prorated refunds are issued for partial billing periods (except as required by law)
6.3 Refunds
We offer a 7-day money-back guarantee on your first payment. If you are not satisfied, email support@smartmalwarescan.online within 7 days of your first charge for a full refund. After 7 days, refunds are at our discretion.
6.4 Failed Payments
If a payment fails, we will attempt to retry the charge. If payment continues to fail, your account will be downgraded to the Free Plan. Your scan history will be retained for 90 days in case you resubscribe.
6.5 Taxes
Dodo Payments acts as Merchant of Record and handles all applicable taxes including VAT, GST, and US sales tax automatically.
7. Intellectual Property
7.1 Our Content
The SmartMalwareScan name, logo, website design, software, algorithms, and all content on this website are owned by or licensed to us. You may not copy, reproduce, or distribute them without our written permission.
7.2 Scan Reports
Scan reports generated for your URLs are provided to you for your personal or business use. You may share reports with clients or colleagues. You may not commercially redistribute scan reports as standalone products.
7.3 Blog Content
Blog articles and guides on this website are our intellectual property. You may quote brief excerpts with attribution and a link back to the original article. Full reproduction requires written permission.
8. Disclaimers
We do not warrant that:
- The Service will detect 100% of all malware, phishing, or security threats (no security tool achieves this)
- The Service will be available 100% of the time without interruption
- Scan results will be 100% accurate or free from false positives or false negatives
- Blacklist data from third-party sources is always current or complete
Security scanning is one layer of protection. A clean scan result does not guarantee a website is free from all security issues. We recommend using multiple security tools and regular professional security audits for mission-critical websites.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SmartMalwareScan shall not be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, business, or goodwill
- Damages resulting from your reliance on scan results
- Security breaches that occur despite clean scan results
- Service interruptions or data loss
Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim, or USD $50, whichever is greater.
Some jurisdictions do not allow limitations on certain warranties or liabilities. If you are in such a jurisdiction, some of the above limitations may not apply to you.
10. Termination
10.1 By You
You may stop using the Service at any time. To delete your Pro account and data, contact us at support@smartmalwarescan.online.
10.2 By Us
We may suspend or terminate your access to the Service immediately if you:
- Violate these Terms of Service
- Engage in prohibited activities
- Fail to pay subscription fees
- Provide false information during registration
We will provide notice before termination where reasonably practicable, except in cases of serious violations.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes will be resolved through binding arbitration or the courts of applicable jurisdiction.
